So says our legal counsel in the U.S.
We received it from a former distributor and self-proclaimed FDA informant, Toby McAdams.
His company has been violating our copyright and trademarks for over 5 years -- with the help of the same renegade FDA officials who destroyed the Alpha Omega Labs facility in the U.S.
It is a felony to extort under existing U.S. federal law . . . even if your extortion efforts are related to working with FDA agents assisting in the theft of your intellectual property.
The letter below is reproduced exactly as we received it at the date and time indicated below. To differentiate my rebuttal / commentary from the original email text, I have put my entries in dark brown ---- Greg Caton

Your_Comments: Seems you are attacking our company again Greg. I let it slide since you were not selling products. Now, I have an issue.

Comment: The author Derrick Jensen says that all writers -- and perhaps we could include people who compose email letters -- are propagandists. Since this includes about 98% of people living in Western civilization . . . (I don't know the exact figure, I just made that up), perhaps that means just about all of us. In any event, there is something deeply ironic -- and perhaps this is a sign of our times -- about someone who has committed a breathtaking smorgasborg of felonous copyright, trademark, and, yes, even FDA violations -- even if he's getting a pass from the Feds because his associates, George Ackerson and Kevin Trudeau, were so helpful in their goal of temporarily destroying Alpha Omega Labs -- and posturing himself as a victim.
It stretches the limits of credibility.
The main thing is . . . Toby McAdams cannot hide his crimes. This very week, he changed the name of his product from Cansema® to Cancema -- that is, he replaced an "s" with a "c," thinking that if the name of his product sounds exactly like ours but is spelled different, he can erase 5 years of trademark violations.
He cannot.
His exact replication of our web pages, artwork, trademarks, medical claims -- everything that was Alpha Omega Labs -- has been immortalized on the Wayback Internet Archive for both RisingSunHealth.com and BloodrootProducts.com from 2002 to 2007. (Even a modest comparison to the archive for Alpha Omega Labs leaves no question as to the originators. In fact, Alpha Omega Labs was first online in September, 1995 -- well before most of the existing internet archiving efforts were even in existence.)
The complicity of the FDA is obvious on many fronts. As it is, in a "wink, wink, nudge, nudge" gesture, the FDA sent a "Warning Letter" to McAdams in April, 2006, not only did he ignore it until this very month (August, 2008), but the bandaid changes he made to his site allows him to keep the essence of his offenses intact.

We live in an Orwellian age where Doublespeak has replaced the language of common sense.
Rather than passing on these absurdities, we are asked to take McAdams seriously. I leave it to the reader to judge whether my assessment is just counter-propaganda.

So here is the option. Below is what we will put on our sites (25) and our affilliate sites on Monday. I will not push the issue with the FDA or Washington on how you can still sell products when you were banned and that what does it take before something is done, Someone must die first.

Comment: People without experience in this business will not interpret this as a veiled death threat -- (even though the only other interpretation is that my products are out there killing people, which is even more proposterous).
But let's put death threats -- or perceived death threats -- aside.
The opening paragraph, like the rest of the letter, is peppered with astonishingly inaccurate statements. When the FDA closed us down, a politically motivated hit that I address in over 300 pages in my upcoming book, Meditopia®, we had 350 different products. The FDA used two of them to come up with criminal charges and let the rest go. Sure, they destroyed our lab, confiscated all the products they could find, pocketed all the cash in our home, threatened to put my wife in prison -- but the Fed does that to nearly everyone it gets an indictment on.
It's now routine.

What the FDA didn't do was put a ban on ANY of our products. It never happened. The charges weren't against the products. They were against the claims that we made on two of our 350 items. The fact that they were true and provable made no difference to the FDA. (It never does).


I will not push the issue if you remove everything or even talk about me or my companies on any of your web sites or other sites or on the phone e-mail. If you decide to agree, I will cease my contact with the FDA and Washington. But if you do the information below and all other contact information will be put on our sites and we will go on all message boards. Let me know. I will check your site Tuesday and have people call Tuesday. I do have names and contact information of products you have recently shipped to the US. I will forward that to John too.

John Armand's calling card Comment: I just love this.
"John" is, of course, John Armand -- the FDA's point man for the destruction of Alpha Omega Labs, whose office is in Covington, Louisiana.
This confirms what I have been saying all along . . . namely, that the FDA has been working with our competitors -- individuals they have contacted who have no problem making an inferior product and selling it under the name of the true trademark owner, whose superior attributes are a problem for the FDA's true employer, the pharmaceutical companies.

America's Autopsy Report ". . . the prognosis is terminal. There can be no recovery of a system that is infected with this much criminal activity. There is no fixing this, especially by voting, which has degenerated into widespread electronic fraud . . .
What will happen is what is happening now. The nation is collapsing into a criminal police state, where the only thing that counts is how much the payoff is. No matter how noble or honest individual sheriffs or legislators are; they're going nowhere against the massive web of corruption now strangling the life out of our once sincere republic.

As for the threat, Toby, to work even more with the FDA than you already have and enlist others in your effort, I'll do you one better -- nearby is Mr. Armand's business card with all his contact information -- click to enlarge. John Armand is a renegade of such unparalleled proportions -- even by FDA standards -- that in a recent civil court action in the U.S. -- totally unrelated to anything having to do with the FDA -- where I acted as an expert witness, Armand attempted to have my affidavit excluded -- with no legal basis for this action.
Armand feels, like so many enforcement agents in the U.S. these days, that he is above the law and above the Courts . . . that, essentially, he can do anything he wants. When Federal Courts fail to rein in this kind of behavior, you end up with out-of-control governance. You end up with something close to Jim Marrs' depiction of the current American Republic -- (see The Fourth Reich).

And this brings to the forefront a much larger issue -- namely, the attack against effective alternatives under the pretense of law. The position is that what makes effective alternatives dangerous is that they don't have the imprimatur that pharmaceutical drugs have. Those alternatives that DO get the support of the FDA tend to be those that are weak, ineffective, or are otherwise of no threat to pharmaceutical drug company profits.
It is probably worth noting that the greatest crimes against humanity were committed under the pretense of law. In the aftermath of World War II, German guards were asked how they could have partaken in some of the most horrific acts imaginable -- to which they replied, "We were just following orders."
Their arguments weren't moral or ethical -- they were legal. And under the narrow confines of German law at the time, there were few concentration camp guards who weren't well within their right to say, "Everything I did was legal. I was just following orders." Or . . . to use the phraseology of my sentencing judge, Tucker Melancon, they were doing what was necessary to conform to the dictates of their "wonderful job."
Unfortunately, the verdict of history has not been so accommodating.
We live in similar times today.
I am of the opinion that my sentencing judge attempted to be as fair and compassionate as he could under the constraints of current U.S. law and the way it is routinely executed. In everything he did he attempted to demonstrate his conscientiousness.
But the law as it is applied in the U.S. today isn't designed to protect the conscientiousness of men like Tucker. It is designed to compromise it.
This is why we must apply another method of evaluation to health care -- simply because the Holocaust of the Second World War pales in comparison to the modern holocaust of the Medical Industrial Complex -- in audacity, atrocity, longevity . . . and body count.

Alpha Omega Scam Update:

Recently Greg Caton reopened Alpha Omega Labs. Here is the problem, Mr. Caton is a fugitive of the law in the US. The FDA is after him for violating a plea agreement and they also want the $950,000. Kevin Trudeau would also like to get his 10 million dollars that he won in a court of law against Mr Caton.

Comment: I believe I am listed by the U.S. Government as an SR (Supervised Release) violator. At least, I think . . . I don't know for sure. I was allowed to travel back and forth under court order to Ecuador from July, 2006 to October, 2007, where I set up a passion fruit oil extraction facility in the northern part of our province (see www.ecuadorpassionfruit.com). While here I encountered a kidney problem that temporarily prevented me from flying back to the U.S. last October (2007). On or about that October 13, I was kindly alerted to a conspiracy involving the same FDA agent who had charges filed on me in the first place, Agent John Armand. I had a court date of October 25, 2007, to have my Supervised Release reviewed by my sentencing judge (Tucker Melancon) so that I could have the rest of my probation discharged. I paid attorney, Lawrence Billeau of Lafayette, Louisiana, $4,000 just to earn the right to get that stupid hearing.
My argument was that my wife and son were already living in Ecuador -- and I wanted to live with them . . . not an entirely unreasonable request for a husband and father. Wanting to live in Ecuador seemed to negate the very purpose for which I was on probation. After all, the entire purpose of the Supervised Release program -- in theory -- is to integrate "criminals" back into society.
I didn't want to be inserted back into the Borg Collective that has now replaced traditional American life.
And I filed a petition with the federal Court in Lafayette to politely say as much.
Quite fortunately for me, I had a former employee, Crystal Leslie, who was annoyed because she didn't get everything she felt she was entitled to when my wife and I sold one of our other manufacturing companies (Lumen Foods or soybean.com, which I founded in 1986 and sold on March 15, 2007). Why was this fortunate? Because Crystal -- reflecting just how much joy, pleasure, and love of sheer audacious truth-twisting she was sharing with her new-found friend, FDA Agent John Armand, spilled her guts under oath and revealed the entire conspiracy to turn my probation release court hearing into a probation revocation hearing. (There were so many provable lies in her October 10, 2007 sworn deposition, initiated by a phony workman's comp claim, that I had to compose a Rebuttal / Commentary to that transcript, too.) Two other employees were being coerced to swear under oath to events that never even occurred so that the coup d'etat would be complete.
This made my choice, my wife's choice, and that of my 11 year old son, easier.

For the record, I never violated my plea agreement. The U.S. goverment is not entitled -- even under their own laws -- to any more money. My former business associate, Kevin Trudeau, did come after me for writing MLM Fraud (1991) and probably for cooperating with the Wall Street Journal in an expose story they did (Fri., Jan. 19, 1996, pg. B-2). He went to court, got an interlocutory judgement in Chicago for $10 million for libel or slander -- I can't remember which. The funny thing is, the very things I disclosed about Trudeau -- which are the basis for his phony $10 million judgement -- can now be read / heard by anybody, anywhere, in his entry on Wikipedia, not to mention YouTube -- and are regarded by average American consumers who are familiar with Trudeau and his antics as factual.
But this is all largely irrelevant to the crucial issues at hand.

To use the term "fugitive" in an attempt to paint a man's reputation pejoratively is to reflect a lack of understanding of the word (from L. "fugere" -- to flee). The United States is a nation of fugitives -- most of them descendants of places where the political, social, or economic conditions of their homeland became intolerable. So they made a decision to move somewhere which, in their time, offered greater freedom and opportunity.
Some Russians moved out of Russia under Stalin.
Chinese out of China under Mao Zedong.
Germans out of Germany under Hitler.
I moved out of the U.S. under Bush.

There are numerous issues involved here. So let me elaborate. Since Mr. Caton is fugitive people purchasing products or selling products from Alpha Omega might expect a visit from the FDA and be asked questions or worse case scenario any and all alternative health products could be confiscated.

Comment: LOL . . . This is ridiculous. The FDA regulates the sellers of products that fall under their jurisdiction -- not the buyers, who they ostensibly exist to protect. I have never heard of the FDA going after the CUSTOMERS of a company they don't like. Just the company. Scare tactics should have some basis in reality.

What started the problems with the FDA for Alpha Omega Labs was the products H3O. It turned out H3O was sulphuric Acic or commonly called battery acid. Alpha Omega put H3O in black salves and other products and that is a dangerous situation. H3O does penetrate fast, but the side effects are serious damage to the skin and possible kidney and liver damage.

Comment: There is not a single sentence, or even subordinate clause, in this tirade that is factually correct. The "problems with the FDA" didn't start with H3O. We didn't even carry H3O until we discovered its original manufacturer in California in 2001. The problem started when Kevin Trudeau -- the infomercial celebrity who wrote "Natural Cures They Don't Want You to Know About," but in actuality works with the FDA for the purposes of uncovering manufacturers and practitioners who do things they don't like -- began to make trouble for us all the way back in 1991. My second book, MLM Fraud (see picture on my personal web page) contained an entire chapter devoted to Trudeau's criminal activities, to which I was an eyewitness: charging people's credit cards for goods and services that never existed. (The picture at right was taken in happier days -- it shows Kevin and I partying in New Orleans for Mardi Gras in 1987).
Getting a $10 million judgement in Chicago through a lawsuit where I wasn't even served notice wasn't good enough. Trudeau began reporting to federal authorities that I had MILLIONS of dollars in unreported income in offshore bank accounts. As proof, he offered up Alpha Omega Labs, which at that time, really did have an office in Nassau (Bahamas). To a normal, thinking person with a three-digit IQ, it's a non sequitur that having an offshore office means you must necessarily have millions of dollars in unreported income in offshore bank accounts.
But not to the geniuses at the IRS and FDA.
Strangely, I didn't even have an offshore bank account. I placed Alpha Omega Labs in the Bahamas so that my international herbal activities would be less likely to irritate the FDA -- the same reasons I had DSHEA disclaimers on every product page on the web site.
From May to September, 2000 -- five months -- I had a full audit from the IRS, wherein IRS Special Agent Keith Monroe camped out at my CPA's offices (Jude Hilliard in Lake Charles, Louisiana) doing everything he could to find out where those millions were.
He never found anything and the IRS did not ask for a single penny in additional taxes. (Something that -- last time I checked -- only happens to 22% of those who undergo a full audit).
I am sad to report that Agent Monroe didn't find the money because I'm just so damn good at being an income tax evader. He didn't find the money because it never existed.
Trudeau had lied to federal officials the entire time.
Three years later, FDA Agent John Armand, whose agency doesn't even handle income tax issues, had the audacity to tell a friend in Chicago (fellow herbalist Carl Manconi) that, among other things, "Your boy, Caton, is going up the river for a long, long time for having millions of dollars in offshore bank accounts. We're nailin' this guy for tax evasion."
There is only one person I know who could have continued peddling that story . . . the one who created it in the first place.

Nonetheless, these pale in comparison to the other lies in the passage above -- lies that came from federal officials themselves. Anyone who has ever purchased our H3O (we have our own made now in South America, but this goes as well for the product we purchased and repackaged back in the States) can test it. The "concentrate" has a pH of between 0.0 and 0.3 -- and yet amazingly, except for some mistaken lab samples I made in Lake Charles in 2007 which were never sold -- it is non-corrosive and non-caustic to animal tissue. No one need take my word for this. They can test it themselves.
Truthfulness, however, has little meaning to federal authorities. Claims were made about H3O in Court for which I had lab reports showing the falsity of what federal authorities were reporting. People don't understand how serious this is.
When Truth has no meaning -- ultimately, the Law has no meaning. To truly understand this is to understand why the United States is a dying republic. It isn't about deficits in the budget or in international trade -- which are just by-products. It's about deficits in truthfulness and moral character.
Addressing the next lie: Our H3O is not battery acid. The only relationship it has with battery acid is sulphuric acid plays a role in the manufacture of both. But they have entirely different properties.
Addressing the next lie: H3O in our salves. We have NEVER used H3O in our salves. We used it in Cansema Tonic III as a preservative, as well as four of our mixed healing clays. It works incredibly well in the tonic application, even though now, for reasons of perceptions, we do not employ it for this purpose in our current tonics.
Addressing the next lie: it isn't dangerous; in fact, as result of my study of the work of Russian medical scientist, Vladimir Volkov, I drink diluted H3O every day to improve digestion and improve my longevity prospects.
Addressing the next lie: H3O does not "penetrate fast." Toby McAdams obviously knows nothing about it. In fact, it doesn't have any transdermal properties whatsoever.
Addressing the next lie: H3O doesn't damage the skin or the kidneys or the liver . . . or the . . . (since Truth has no bearing here, I'm was waiting to see if Toby could name any other organs of the abdominal cavity . . . )

As a result of Alpha Omega reopening the FDA released a recent list of products and companies that sell cancer products.

Comment: . . . and with this Thunderbolt . . . I, Zeus, King of the Gods on Mount Olympus . . . LOL . . . LOL . . .
The reader will have to judge for himself as to my omnipotent power to single-handedly cause a U.S. agency with a $2 billion a year budget to institute an anti-alternative medical policy.
The recent "attack list" is a routine operation, similar to "Operation Cure-All," which was conducted in 2003.

From my understanding the FDA will even go further. Alpha Omega is selling products that are tainted and have caused serious damage to people.

Comment: Tainted?
Not even the FDA itself ever claimed that my products were tainted. Their attack line was that the claims on our web site, in spite of the use of DSHEA disclaimers for U.S. users, were in violation of FDA law.

As a result companies that are complying with the FDA requirements are suffering now. Should someone get injured or heaven forbid dies, the alternative health industry will be affected seriously. Our company had the FDA visit for 3 days we have done what has been requested so far and we are open so are numerous other companies, so complying to the FDA is not bad. I disagree with some of the requirements but now I know why they are so strict. It is because of companies like Alpha Omega labs. At one time Alpha Omega labs was a reputable company, now there are not. It is sad.

Comment: . . . LOL . . . Toby McAdams needs to get someone from the FDA to improve his extortion letters. This copy is awful . . . The simple fact is that no other company of which we are aware has the curative track record, told in the words of our own customers, on our web site and on hundreds of other web sites, that Alpha Omega Labs has. In fact, the FDA let you take the testimonials on our website and put them on your own as if anything you ever made or sold had anything to do with those very testimonials. We had to deal with angry letters from our customers, telling us, "Why is the FDA letting this guy getting away with this fraud? I don't even know him, but he is using my testimonial."
The part about our being a reputable company in the past, but not now . . . I have news for Toby -- Agent John Armand's newest lap dog: our reputation has not diminished. It has improved as a result of my imprisonment. More than one practitioner has called us and said, "You know . . . your stuff must have really worked and helped a lot of people or the FDA would not have gone this far."

So here is what to expect: Supporting companies like Alpha Omega can and most likely will cause the FDA to be more stringent. Furthermore, regulations addressing the Alternative and Dietary Supplement Industry could be come more stringent and also ban numerous products. Here is what we know: Greg Caton plead guilty to the FDA charges and he and Alpha Omega labs was not to sell any products that were not approved by the FDA.

Comment: First of all, we were never banned from selling products in the U.S. This appears NO WHERE in my plea agreement or any of the other 100 or so legal documents that comprise my criminal case in the U.S. We provide a Comparable Products page so people know where they can get our best products from other U.S. suppliers . . . well . . . for two reasons . . . first to show that we respect U.S. laws, however ridiculous it may be that the U.S. Goverment can't follow them itself (see Federal Judge Andrew P. Napolitano's "Constitutional Chaos: What Happens When the Government Breaks Its Own Laws"), but secondly, because we are so well-known in what we do internationally that even after having been closed for 5 years, we can survive successfully on sales outside of the U.S.
We didn't leave the U.S. just so we could go to another country and thumb our nose from 2,000 miles away -- hell, U.S. Courts act like they have jurisdiction over the entire planet anyway -- (see "Chaos," p. 7).
We left for the same reason that America's ancestor fugitives emigrated to America in an earlier era.

The earlier statement in this passage is even more ridiculous. What you are told is: "You have to buy my adulterated, misbranded product, instead of the original product -- which really works -- or it could hurt our industry and the FDA will ban numerous products as a result."
Readers will have to determine for themselves how much of this cognitive disonance they can tolerate.

Recently Alpha Omega reopened and is selling products. So, here is what you can expect.

Comment: We've reopened and we're selling product . . . okay . . . a truthful statement.
Damn . . . this is unbelievable . . . I can't believe it . . .

The FDA wants Mr. Caton and they will do what is needed to catch and arrest him, so if they need to track products people purchased products from Alpha Omega labs in the United States, they most likely will.

Comment: The FDA isn't tracking anybody down in this neck of the woods. Our President, Rafael Correa, who's had enough interventionist nonsense to last the next 50 years has told the U.S. that the Manta base lease will not be renewed. Occidental Petroleum got kicked out of here for cheating on its taxes . . . these are not examples of anti-Americanism. These are examples of South American countries exercising their sovereignty and demanding the unthinkable -- namely, that their laws be respected by foreigners -- especially those who don't follow their own laws.
As for areas of life that DO fall within the FDA's purview, Ecuador is a farmer's market of alternative practice. Many of them are personal friends . . . people like Dr. Robert Wickman, D.O., Dr. Gary Young, Neville Solomon -- they are all successful in their practices, they've all been indicted in the U.S., they all have droves of Americans coming down here who don't want to be murdered by conventional medical doctors back in the States, they've all been here for years . . . and they all have no intention of ever moving back to the U.S.
For the life of me, I can't understand why.

As for the suggestion that the FDA is going to track people down, like dogs, who have purchased our products. What nonsense.


Alpha Omega labs could possibly, by their actions force the US congress to change and add new dietary supplement and alternative health product laws. We do not need this. If people or companies purchase products from Alpha Omega labs and Alpha Omega labs keep in business; alternative health products could and possibly will become regulated or banned. If this happens, don’t complain. Supporting Alpha Omega Labs is a serious issue, they have been banned from selling in the US. You can get the same products from other companies that follow the FDA rules and are providing products in the US legally. You can believe a Fugitive of the law in Greg Caron and Alpha Omega Labs or companies that are presently conforming toe present laws to alternative health products are available. If someone sells or offers products from Alpha Omega Labs go someplace else to get your products.

As for getting "the same products from other companies that follow the FDA," this wouldn't apply to Toby McAdams anyway for the many reasons cited above.

I have contacted the FDA and US Attorney. The FDA agent involved is John Armond his number is (985) 809-6722. I have a message with the US Attorney assigned the case to get permission to post his contact number. I have also contacted Kevin Trudeau to get permission to post contact information for him. There are 5-8 more companies and individuals I have contacted to provide contact information for them. I will update this information as soon as I get authorization and you as a consumer can contact them. I am also contacting US Senators and Representatives to find out how a company banned from selling products in the US is still allowed to reopen. I will also ask them if someone must die before something is done.

Will it help, Toby, if I write a letter to the FDA myself and ask them to assist you in continuing to put out adulterated, misbranded products using our copyrighted and trademarked materials? Oh -- that's right, I forgot, they've been deliberately doing that already for the past six years.
